As a traveler, the CLIENT understands clearly that travel to anywhere in the world involves inherent risks. These inherent risks include, but are not limited to, the risk of injury or death from motor vehicle collisions, animals, roadway hazards, slips and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; the CLIENT's own negligence and/or the negligence of others, including tour guides, other travelers, and VELOCITY TOURS; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical exertion for which the CLIENT is not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accidents or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided. The CLIENT understands that the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. The CLIENT is willing to accept the risks and uncertainty involved as being an integral part of travel, including, but not limited to, the risk of infection, illness, and death. The CLIENT hereby accepts and assumes full responsibility for any and all risks of illness, injury, or death and of the negligence of VELOCITY TOURS and agrees to hold VELOCITY TOURS harmless and fully release it from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of VELOCITY TOURS, and the CLIENT hereby covenants not to sue VELOCITY TOURS for any such claims or join any lawsuit or action that is suing VELOCITY TOURS. This agreement also binds the CLIENT's heirs, legal representatives, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise. *

As the worldwide COVID-19 coronavirus pandemic remains ongoing at this time, the CLIENT also acknowledges that for this reason and other reasons not reasonably foreseeable, travel plans may be interrupted or canceled by SUPPLIERS, a government entity, and/or other third parties over which VELOCITY TOURS has no control. The SUPPLIER's own cancellation, rebooking, and refund policies, subject to any applicable law that is now or may later be in effect, will govern CLIENT rights and remedies, including your right to receive a refund, in such an event. In addition, while there is always an inherent risk that the CLIENT takes when deciding to travel, the current pandemic (namely COVID-19) brings a new set of risks and challenges that need to be understood before VELOCITY TOURS agrees to book the CLIENT's upcoming trip. Some of the new risks and considerations, but not all, are laid out in this waiver. By booking the CLIENT's upcoming trip with VELOCITY TOURS, the CLIENT agrees to these additional terms and is bound by this agreement and any additional terms and conditions of the SUPPLIER applicable to the CLIENT's travel arrangements. The CLIENT agrees to hold VELOCITY TOURS harmless for any and all responsibility after the acceptance of this waiver. Notice that repatriation will not be a quick response by the United States government, and the CLIENT may be stuck in a country responsible for their own care and accommodations and at additional personal expense. VELOCITY TOURS has no control over governmental or health authorities as it relates to safety protocols put in place, which may include, but are not limited to, temperature checks, the requirement to wear a face mask, required on-site COVID-19 tests at the CLIENT's own expense, mandated quarantines, or refusal of entry into a destination. The CLIENT is traveling at their own risk, realizing that there is a possibility of exposure or contraction of the COVID-19 virus or another pandemic during travel. The result may require quarantine procedures as dictated by the governing body in the United States or in the destination the CLIENT is traveling to. Any additional expenses incurred from these procedures are the CLIENT's responsibility. By purchasing travel through VELOCITY TOURS, the CLIENT will not hold VELOCITY TOURS liable for any financial, physical, mental, or emotional consequences that may arise. Covid-19 and/or future pandemics may limit the services and amenities available at the CLIENT's destination. Experiences such as offsite excursions and watersports may be limited or unavailable. Dining and beverage options may also be limited at the resort or cruise line's discretion. By purchasing the CLIENT's trip through VELOCITY TOURS, the CLIENT understands that these limitations are out of VELOCITY TOURS' control and not a release from SUPPLIER's payment terms and conditions. If the CLIENT's plans are canceled due to force majeure, the CLIENT is bound by the payment terms and conditions of each SUPPLIER. This may mean that the CLIENT's deposit will not be refunded, change/cancellation penalties will not be waived, or the CLIENT may be required to accept a voucher for future use instead of a cash refund. This is not at VELOCITY TOURS' discretion to change or modify; this comes directly from SUPPLIERS such as airlines, tour operators, cruise lines, and hotels. However, VELOCITY TOURS will continue to advocate for the CLIENT through the process with the SUPPLIER. A claim with the travel insurance companies is filed by the CLIENT. Any initial "plan to go" deposit paid to VELOCITY TOURS remains non-refundable. Refunds from SUPPLIERS are considered cancellations while "Plan To Go" deposits are considered earned. The bulk of VELOCITY TOURS' business is conducted via the use of credit or debit cards, including MasterCard, Visa, Discover, and American Express. *

The current travel environment has been and continues to be very dynamic. Travel requirements and policies are subject to change at any time without notice. The CLIENT is responsible for knowing the laws and regulations for passports, vaccinations, visas, and any other travel requirements outlined by the location being traveled to and through. VELOCITY TOURS tries to provide the CLIENT with the latest information regarding the policies related to destination entry requirements as well as policies related to each travel component booked through VELOCITY TOURS. (This information can be found on the web or destination countries Embassy.) The CLIENT agrees to hold VELOCITY TOURS harmless if any changes could impact the ability to travel and complete the trip. VELOCITY TOURS recommends that every passenger register with the www.travel.us.gov/STEP program. It is the CLIENT's responsibility to register independently as this is a government locator program designed to track US travelers abroad. It is also the CLIENT's responsibility to monitor recommendations from sources such as the Center for Disease Control and the World Health Organization and make an informed decision regarding their travel plans. *

For the CLIENT's protection, VELOCITY TOURS strongly recommends that the CLIENT purchase travel insurance. If the CLIENT chooses to decline travel insurance, the CLIENT is assuming any financial loss associated with canceling or altering their travel arrangements. These losses often total 100% of the trip cost. The CLIENT also assumes any financial losses due to the inherent risk of travel as stated in the section "INHERENT RISK OF TRAVEL." No representation or description of travel cancellation or travel insurance made by VELOCITY TOURS constitutes a binding assurance or promise about travel insurance. It is CLIENT’S responsibility to ensure their trip is insured.
